The Basis Of Fiqh Jaffari'ah

HAZRAT IMAM JAFFAR SADIQ WAS A TRUE MUSLIM. THE SHIA
TAKE HIM AS ONE OF THEIR LEADING IMAM WHO FOUNDED
FAIQH JAFARI'AH OR THE SHIA JURISPRUDENCE. HOWEVER,
THE FACT IS THAT IMAM JAFFAR SADIQ WHOSE HOUSE IS EVEN
NOW PRESERVED NEAR MASJID NABVI, MADINAH PRAYED FIVE
TIMES PRAYERS BEHIND THE IMAM OF THAT TIME IN THE
AFORESAID MASJID AND PAID ZAKAT TO THE THEN MUSLIM
RULERS.

THE PRESENT SHIA WHO ASCRIBE THEIR FIQH
(JURISPRUDENCE) TO IMAM JAFFAR SADIQ HAS NO BEARING AS
THE FOUR FAMOUS BOOKS ON SHIATHEOOGY WERE COMPILED
MUCH AFTER THE DEATH OF IMAM JAFFAR SADIQ. THEIR WAS
NO SUCH THING AS FIQH JAFFIRAH IN THE 1ST AND 2ND
CENTURY OF THE HIJRI YEAR.

THE FOUR BASIC BOOKS OF SHIA THEOLOGY ARE AS UNDER :-

(i) AL-KAFI ( ) BY ABU JAFFAR KULAINI 330 H I.E.
WRITTEN 180 YEARS AFTER THE DEATH OF IMAM JAFFAR
SADIQ.

(ii) (MAN LA YAHDHURHUL FAQIH) BY MUHAMMAD BIN ALI IBN
BAYUAH QUMI 381 H I.E. WRITTEN ABOUT 230 YEARS AFTER
THE DEATH OF IMAM JAFFAR SADIQ.

(iii) (TAHZIB UL AHKAAM)

(iv) (AL-ISTIBSAR) BOTH BY MUHAMMAD BIN HASAN YUSI 460
H I.E. WRITTEN AFTER 310 YEARS OF THE DEATH OF IMAM
JAFFAR.

THUS IT WOULD BE SEEN THAT THE AFORESAID BOOKS WERE
COMPILED AFTER 180 TO 310 YEARS OF THE DEATH OF IMAM
JAFFAR SADIQ IN ACCORDANCE WITH THE SHIA PRACTICES OF
FABRICATION AND FALSEHOOD. IT IS FUTILE TO TRACE THE
SOURCE OF FIQH JAFFARIAH FROM THE BOOK OF ALLAH AS
ACCORDING TO SHIA BELIEF QUR'AN HAS BEEN SUBJECTED TO
TAHRIF (PERVERSION).

THESE ARE NO INDICATIONS THAT FIQH JAFFARIAH WAS EVER
INTRODUCED OR IMPLEMENTED IN ANY OF THE MUSLIM
COUNTRIES LIKE EGYPT DURING THE ABBASIDE CALIPHATE
FROM 659 TO 923 H, OR TURKEY DURING THE OSMANIA
CALIPHATE FROM 1288 TO 1924 (WHEN MUSTAFA CONTINENT
RIGHT FROM THE REIGN OF MUHAMMAD GHORI TO THE LAST
MOGHAL EMPEROR.

IN SHORT, NO MUSLIM GOVERNMENT IN ANY AGE HAS GIVEN
ANY PLACE TO FIQH JAFFARI'AH IN THEIR LAW OR
CONSTITUTION.

IT IS AN OPEN FACT THAT HAZRAT ALI DURING HIS
CALIPHATE ACTED UPON THE FIQH OF HIS PRECEDECESSORS
(ABU BAKAR, UMAR & USMAN). WHY THEN THOSE WHO TODAY
CLAIM LOYALTY TO ALI ARE AGAINST THIS FIQH (BASED ON
THE QUR'AN AND SUNNAH) WHICH HAS BEEN FOLLOWED BY THE
UMMAH THROUGHOUT THE AGES?

THE PRESENT POLICY OF APPEASEMENT OF SHIAS BEING
FOLLOWED IN PAKISTAN WHO ARE ONLY 2 1/2% OF THE TOTAL
POPULATION IS REPLETE WITH GRAVE DANGERS AS THE PAST
EVENTS HAVE ALREADY PROVED. THE MEN IN AUTHORITY
SHOULD COOLY TAKE STOCK OF THE SITUATION AND TAKE A
COURAGEOUS AND RESOLUTE STAND IN THIS REGARD IN
KEEPING WITH THE REQUIREMENTS OF SHARIAH. IF THE
SUNNIS IN IRAN WHO ARE NO LESS THAN 35% OF THE TOTAL
POPULATION OF IRAN ARE GIVEN NO EXAMPTION AND ARE
GOVERNED BY THE PUBLIC (SHIA) LAW OF THAT COUNTRY, WHY
UNDUE FAVOURS SHOULD BE SHOWN TO SUCH A MINORITY UNDER
WHOSE LEADERSHIP (YAHYA KHAN) WE LOST EAST PAKISTAN
AND WHO DAY IN AND DAY OUT ARE NOT TIRED OF REVILING
THE COMPANIONS OF THE PROPHET (SAW).

THE SHIAS BECAUSE OF THEIR BELIEFS CANNOT BE LOYAL TO
ANY MUSLIM GOVERNMENT. ACCORDING TO THEIR BELIEF ALL
THE MUSLIM GOVERNMENT PRIOR TO THE ADVENT OF IMAM
GHAIB (ONE WHO DISAPPEARED) ARE UNJUST AND OPPRESSIVE.
IF THESE PEOPLE OUTWARDLY PROFESS LOYALTY TO A CERTAIN
MUSLIM RULER OR GOVERNMENT, IT IS OWING TO THEIR
PRACTICE OF TAIQYA AS THEIR HATRED IS INGRAINED
AGAINST THE SUNNI MUSLIMS. ACCORDING TO HISTORIAN IBN
KHULDUN, SHIAS WERE RESPONSIBLE FOR THE SACK OF
BAGHDAD AS THEY INVITED HALAKU KHAN TO ATTACK THE THEN
MIGHTY MUSLIM EMPIRE.

IT IS SELDOM REALISED THAT SHIA MINORITY IS A GREAT
STUMBLING BLOCK IN THE ENFORCEMENT OF SHARI'AH IN
PAKISTAN.

THE ZAKAT & USHR ORDINANCE WAS PROMULGATED IN PAKISTAN
1980. HOWEVER, ITS PRACTICAL APPLICATION IN THE
COUNTRY RAISED A NUMBER OF EYE BROWS WHICH WAS QUITE
NATURAL AS THE SYSTEM OF ZAKAT AT OFFICIAL LEVEL WAS
THAT NO MUSLIM SHOULD BE EXEMPTED FROM THE LEVY OF
ZAKAT AND USHR AS THERE IS NO SUCH PRECEDENCE IN
ISLAMIC HISTORY. ANYONE WHO IS A MUSLIM HAS TO PAY
ZAKAT AND USHR AS A MATTER OF RELIGIOUS OBLIGATION.
REFUSAL TO PAY ZAKAT IN FACT IS DENIAL OF ONE OF THE
PILLARS OF ISLAM AND THE DENIAL OF ONE THE PILLARS OF
ISLAM IS THE DENIAL OF THE ENTIRE EDIFIC OF ISLAM.
THAT IS WHY HAZRAT ABU BAKAR WAGED WAR AGAINST THOSE
MUSLIM TRIBES WHO REFUSED TO PAY ZAKAT AFTER THE
DEMISE OF THE HOLY PROPHET (SAW). IF THE MEMBERS OF
ANY SECT CONSIDER THEM AS MUSLIMS, THEN THEY CANNOT
GET THEMSELVES EXEMPTED FROM THE PAYMENT OF ZAKAT &
USHR WHICH IS A RELIGIOUS OBLIGATION. EVERY ISLAMIC
STATE IS OBLIGED TO COLLECT SUCH AN MANATORY PAYMENT.
IF ANY MUSLIM REFUSES TO MAKE SUCH PAYMENTS, HE CASTS
HIMSELF OUTSIDE THE PALE OF ISLAM. AS SUCH THE
EXEMPTION GIVEN TO SHIAS IN THE AFORESAID ORDINANCE IS
AGAINST THE TEACHINGS AND SPIRITOF ISLAM.

ANOTHER DRAWBACK ACCURING FROM SUCH EXEMPTION IS THAT
MANY FEABLE-MINDED SUNNI MUSLIMS HAVE SUBMITTED
DECLARATIONS TO THE EFFECT THAT THEY ARE SHIAS IN
ORDER TO ESCAPE FROM THE PAYMENT OF ZAKAT AND USHR. ON
ACCOUNT OF THIS DUPLICITY, THE NUMBER OF SHIAS HAVE
SWELLED UP IN PAKISTAN IN THE RECENT YEARS.

NO MUSLIM RULER HAS THE RIGHT TO INTERFERE IN THE
INJUNCTIONS OF ISLAM. HE HAS NO AUTHORITY TO GIVE
EXEMPTIONS FROM SHARI'AH DOES SO VIOLATES THE SHARI'AH
AND WILL BE ANSWERABLE TO ALLAH ON THE DAY OF
JUDGEMENT!

NOTES

1. THE SHIAS HAVE BEEN GIVEN EQUAL REPRESENTATION WITH
AHLE-HADITH, BRALVI AND DEOBANDI GROUPS OF AHLE-SUNNAH
IN THE COUNCIL OF ISLAMIC IDEOLOGY, GOVERNMENT OF
PAKISTAN AND BECAUSE OF THIS UNFORTUNATE SITUATION THE
PACE OF ISLAMISATION CANNOT BE ACCELERATED DUE TO
OBSTRUCTIONS CREATED BY THE SHIAS ON INSTRUCTIONS FROM
OUTSIDE ELEMENTS WHO DO NOT WANT TO SEE PAKISTAN
DEVELOP INTO A TRULY ISLAMIC STATE ON SENTED IN THE
DELIBERATIONS OF THE COUNCIL OF ISLAMIC IDEOLOGY JUST
AS SUNNIS IN IRAN ARE NOT TAKEN ON SUCH BODIES THERE.
